As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these Terms and Conditions to make sure that they contain all that you want and nothing that you are not happy with.
These Terms and Conditions are provided in English. For users in Spain (or other Spanish-speaking regions), we will make these Terms available in Spanish to ensure you can review them in your primary language. Both language versions are equally valid. In the event of any inconsistency, the version in the language of your residence shall prevail to the extent required by applicable law.
Application
These Terms and Conditions will apply to the purchase of the services by you (the Customer or you). We are GYMDATE Ltd a company registered in England and Wales under number 15180325 whose registered office is at 66 Wimpole Street, W1G 8AW with email address info@gymdateapp.com; (the “Supplier” or “us” or “we”).
These are the terms on which we sell all Services to you. Before placing an order on the Website or the App, you will be asked to agree to these Terms and Conditions by clicking on the button marked ‘I Accept’. If you do not click on the button, you will not be able to complete your Order. You can only purchase the Services from the Website if you are eligible to enter into a contract and are at least 18 years old.
Governing Law
These Terms and any dispute or claim arising from them are governed by the laws of England and Wales. You and Gymdate agree that the courts of England and Wales shall have jurisdiction. However, if you are a consumer resident in the European Union, nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence. You may thus bring legal proceedings in your local courts if so entitled under applicable law. Similarly, if you reside in a jurisdiction that provides you with non-waivable consumer rights (such as Scotland or Northern Ireland in the UK, or any country with similar protections), you will not be deprived of those rights, and local courts may have jurisdiction as provided by law. This clause does not limit any rights you have under applicable law.
Interpretation
Consumer means an individual acting for purposes which are wholly or mainly outside their trade, business, craft or profession;
Contract means the legally-binding agreement between you and us for the supply of the Services;
Durable Medium means paper or email, or any other medium that allows information to be addressed personally to the recipient, enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purposes of the information, and allows the unchanged reproduction of the information stored.
Order means the Customer’s order for the Services from the Supplier as submitted following the step by step process set out on the Website;
Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;
Services means the services advertised on the Website, of the number and description set out in the Order;
Website means our website www.gymdateapp.com on which the Services are advertised.
App Store means any third-party platform through which Gymdate is distributed and from which you can purchase subscriptions (e.g., Apple App Store, Google Play).
Terms and Condition of use for GYMDATE
Welcome to Gymdate (“App”). Before using our services, please carefully read the following terms and conditions (“Terms”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the App.
- User Eligibility
You must be at least 18 years old to register for or use Gymdate. By creating an account, you represent and warrant that you are 18 or older. Gymdate reserves the right to verify your age (for example, through SMS or email verification, and by requesting additional proof of age if necessary) and to suspend or terminate your account if we suspect you are under 18. The service is not intended for anyone under the age of 18.
- User Accounts
2.1. Registration
To access certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
2.2. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

You agree not to engage in any activities that may violate these Terms, applicable laws, or the rights of others. This includes, but is not limited to, harassment, impersonation, or any form of illegal content.
- User Content
By posting content (such as profile photos, bios, messages) on Gymdate, you grant Gymdate a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display that content for the purpose of operating, developing, and promoting the Service. This license ends when you delete the content or your account, except to the extent your content has been shared with others and they have not deleted it. You represent that you have all necessary rights to grant this license.
- Subscriptions & Payments
- Subscription Plans and Billing
Some features of Gymdate are premium and require a paid subscription. Auto‑Renewal: When you subscribe, you agree that your subscription will automatically renew at the end of each billing period (e.g. monthly or annually) unless you cancel. You authorize Gymdate (or the applicable app store) to charge the recurring subscription fee to your provided payment method until you cancel. We will notify you of any increase in the subscription price or material changes to the subscription terms in advance, and such changes will apply from your next billing period (you will have the opportunity to cancel before the change takes effect if you do not agree to the new price or terms). At the point of purchase, we will clearly disclose the recurring nature of the subscription and obtain your express confirmation before you complete your order, in accordance with applicable consumer protection laws.
- Cancellation and Refunds
You can cancel your subscription at any time before your next renewal date to avoid future charges. To cancel, if you purchased the subscription through a mobile app store (such as Apple App Store or Google Play), you must follow that store’s instructions for cancellation (e.g. through your device’s account subscriptions settings). If you purchased directly through Gymdate’s website or app (using a credit card or other payment), you may cancel by visiting your Gymdate account settings or contacting our customer support. Cancellation takes effect at the end of your current billing period, meaning you will retain access to premium features until that period expires and will not be billed again thereafter. Gymdate will send you an email confirmation when you purchase a subscription and when you cancel, to confirm the effective date of cancellation and the status of your subscription. We strive to make the cancellation process as simple as the sign-up process, in compliance with applicable laws.
- Refunds and Withdrawal Rights
In general, fees are non-refundable. When you cancel a subscription, you will continue to have premium access for the remainder of the period you’ve already paid for, but you will not receive a refund for that period (unless required by law). However, if you are a consumer in the European Union, you have a legal right to withdraw from your subscription purchase within 14 days of the purchase date (the “cooling-off period”). If you wish to exercise this right, you must inform us of your decision to cancel within the 14-day period. Please note: by purchasing a Gymdate subscription, you request and consent to us providing the premium service to you immediately, and you acknowledge that if the service is fully delivered to you within the 14-day period, you will lose your right to withdraw from that purchase. In practice, this means Gymdate may ask you to explicitly agree (at the time of purchase) that you want instant access to premium features and that you understand this waives the cooling-off cancellation right once the service is provided in full. If you do not agree to waive this right, you should refrain from accessing the premium features for the first 14 days. If you cancel a subscription within 14 days without having waived your withdrawal right, and the premium service has not been fully performed, Gymdate will refund you in accordance with applicable law – typically, we may deduct a pro-rated amount for the days you used the premium service and refund the remainder. Beyond any statutory withdrawal rights or other rights mandated by law, Gymdate does not offer refunds for unused time or partial use of our services. This Refunds policy does not affect any rights you may have under consumer-protection laws to obtain refunds for specific circumstances (and any such required refunds will be provided in accordance with the law).

Your use of the App is also governed by our Privacy Policy, which outlines how we collect, use, and disclose your information.
- Modifications & Terminations
- Changes to Terms
We reserve the right to modify these Terms at any time. Updated terms will be effective upon posting on the App.
- Termination by Gymdate
We reserve the right to suspend or terminate your account at any time, at our reasonable discretion, if we believe that you have violated these Terms (including the Code of Conduct) or any applicable law, or if your use of the Service creates risk or possible legal exposure for us, our users, or others. We may also remove or disable any content you have posted that is found to violate these Terms or the law. In most cases, we will attempt to notify you of such action and the reason for it, but we are not obligated to do so in urgent or flagrant cases. If your account is terminated under this section, you will not be entitled to any refund of fees (except as required by law) and you may be prohibited from re-registering or using the Service in the future. This termination clause does not limit our other rights to refuse service or enforce our terms.
- Disclaimers and Limitation of Liability
- Disclaimer
Gymdate provides the Service on an “as is” and “as available” basis. To the maximum extent permitted by law, Gymdate disclaims all warranties of any kind, whether express or implied, regarding the Service, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Service will be error-free, secure, or uninterrupted, or that results obtained from using the Service will meet your expectations.
You understand that Gymdate is not responsible for the conduct of any users and does not perform background checks; use caution in your interactions with others.
- Limitation of Liability
To the fullest extent permitted by applicable law, Gymdate (and its officers, directors, employees, and agents) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.
Gymdate’s total aggregate liability for any claims arising from or related to the Service or these Terms will not exceed the amount (if any) you paid to us for the Service in the 12 months preceding the claim, or €100, whichever is greater, to the extent such a limitation is permitted by law.
- No Exclusion of Mandatory Liability
Nothing in these Terms shall exclude or limit Gymdate’s liability where such liability cannot be excluded or limited by law. In particular, we do not exclude liability for Gymdate’s own fraud, fraudulent misrepresentation, or intentional misconduct, or for death or personal injury caused by our negligence. Additionally, if applicable law (for example, certain consumer protection laws) does not allow the exclusion of Gymdate’s liability for gross negligence, we do not exclude liability on that basis to the extent of the law’s prohibition. Subject to the foregoing, any liability that we cannot wholly exclude is limited to the smallest extent permitted by law.
This clause does not affect any statutory rights you have as a consumer. If applicable law in your jurisdiction provides you certain remedies or compensation for damages, those rights remain available to you and are not waived by these Terms.

We are committed to user satisfaction. If you have a question, concern, or complaint about the Service, please contact our customer support at info@gymdateapp.com. We will acknowledge and attempt to resolve your issue as soon as possible. If we cannot resolve your complaint to your satisfaction, you may pursue formal dispute resolution as outlined under the Governing Law & Jurisdiction section of these Terms. You also have the right to seek guidance or assistance from consumer protection authorities in your country, if applicable. (Please note: while an EU online dispute resolution platform existed previously, it is no longer operational as of 2025, so we handle disputes directly.) We hope to resolve any issues by working with you in good faith.
Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland. If you are a consumer resident in the EU, you may also have the right to bring proceedings in your local jurisdiction and benefit from mandatory protections under your local consumer laws.
We try to avoid any dispute, so we deal with complaints as follows: In the event of a dispute, we encourage users to reach out to us for resolution. Our commitment is to provide a timely and fitting solution.

Code of Conduct
By using Gymdate, you agree to follow our Code of Conduct. This means you will not engage in any illegal or unauthorized activities on the platform. Prohibited conduct includes, for example: harassing or hateful behavior, sharing obscene or explicit material, impersonating others, or any use of Gymdate that violates applicable laws or regulations. You are responsible for any content you post. Unlawful content or behavior is strictly prohibited.
By using our app, you agree to abide by these guidelines:
- Respect Others: Treat all users with respect and kindness. Do not engage in any form of harassment, discrimination, or hate speech. Be mindful of cultural differences and personal boundaries.
- Honesty and Authenticity: Use accurate and recent photos of yourself.
Provide truthful information in your profile. Do not impersonate someone else or misrepresent yourself. - Privacy and Safety: Protect your personal information and report any suspicious activity.
Do not share sensitive information, such as your address, financial details, or personal contact information. Report any user who makes you feel uncomfortable or unsafe. - Consent and Boundaries: Always seek and respect consent in your interactions.
Do not pressure or coerce anyone into any activity. Respect the boundaries set by others. - No Harassment: Do not engage in stalking, threats, or unwanted attention. Report any harassment promptly to our support team.
- Inappropriate Content: Refrain from posting explicit or offensive content. Report any offensive or inappropriate content you encounter.
- No Spam or Scams: Do not engage in spam, scam, or fraudulent activities. Report any suspicious profiles or activities.
- Moderation and Reporting: Our app is moderated, and we encourage users to report violations of this code of conduct. Users who repeatedly violate these guidelines may face suspension or removal from the platform.
- Account Security: Keep your login credentials secure. Do not share your account with others.
- Feedback and Suggestions: We value your feedback and suggestions for improving our app and safety measures.
- Legal Compliance: Users are expected to adhere to all applicable laws and regulations.

By using GYMDATE, you agree to these terms and guidelines. We reserve the right to suspend or remove any user who breaches this code of conduct.
